The Villages Swimming Pool Accident Lawyer

Swimming pools are a way of life in Florida. With hot, humid weather most of the year, swimming pools offer a great respite from the heat, provide a great opportunity to get the kids outside and exercising, and make family get togethers and dinner parties all the more entertaining. In fact, Florida ranks 2nd in the country in terms of swimming pools per capita, according to Porch Data. But swimming pools are not all fun and games. Swimming pool accidents can result in head injuries, fractured limbs, and drowning fatalities. If you or a loved one were injured in a private swimming pool accident, a Florida child injury lawyer can review your case to determine whether there was wrong doing on behalf of the property owner.

Drowning is a Leading Cause of Death for Children

The top cause of fatal unintentional injuries for children up to four years old is drowning, according to the Centers for Disease Control and Prevention (CDC). Even if a young child knows how to swim or stay afloat, drowning can still occur in residential swimming pools. Additional risk factors for drowning deaths and injuries include:

  • The pool not being properly fenced or gated;
  • Lack of parental supervision;
  • Unsafe pool deck (cluttered, cracked, excessively slippery, etc.);
  • No stairs or ramp to get out of the pool;
  • Unsafe diving board that could lead to a head injury, followed by drowning; and
  • Other avoidable risk factors that the property owner should have remedied.

Common Florida Swimming Pool Injuries

  • Traumatic brain injury;
  • Spinal cord injuries;
  • Spinal column injuries;
  • Fractured skull;
  • Broken limb;
  • Whiplash;
  • Contusions and lacerations;
  • Fatal drowning;
  • Nonfatal drowning resulting in brain damage or other organ damage; and
  • Hypothermia.

Swimming Pool Laws in Florida

Under Chapter 15 of the Florida Residential Pool Safety Act, swimming pools must include the following safety features:

  • Pool must be equipped with an approved safety cover;
  • Isolated with a barrier at least four feet high that has no gaps or openings large enough for a young child to crawl through;
  • The barrier must be separated from all structures and walls unless the wall is used as part of the barrier;
  • The barrier must be far enough from the water’s edge to prevent a young child or medically frail elderly person who may have managed to penetrate the barrier from immediately falling into the water;
  • Any direct window or door that directly access the pool must be equipped with an exit alarm that has a minimum sound pressure rating of 85 dB A at 10 feet;
  • Doors directly accessing the pool must have a self-closing and self-latching device at least 54 inches above the floor;
